The EEA-EFTA states do have a so-called right of reservation under Article 102, but the EU also has a right to suspend the ‘affected area’ of the Agreement if they choose to exercise it, and then to make ‘adjustments necessary due to the suspension’. In other words, the EU would be able to punish the recalcitrant state if it dares to step out of line. So it is not a true veto, in the normal sense of the term. Norway did initiate the process in 2011 with respect to the 3rd Postal Directive, but drew back from it in 2013 after a change of government, and swallowed the Directive.
A further factor that makes the right (if such it may be called) almost impossible to exercise is that all the other EEA-EFTA states would be affected by the suspension of the affected area, and subsequent ‘adjustments’.
